
Virginia State Income Taxes
The Commissioner of Revenue’s Office, located on the 2nd floor of the Bozman Government Center, is closed to the public until further notice.

Per the Virginia Tax website:
Individual Income Tax Filing Due Dates
- Per the Virginia Tax website: Typically, most people must file their tax return by May 1. However, the filing deadline for 2020 individual income tax returns has been extended to Monday, May 17, 2021. For more information about filing your return this year, see Avoid Pandemic Paper Delays: Tips for Filing Season.
- Fiscal year filers: Returns are due the 15th day of the 4th month after the close of your fiscal year.
If the due date falls on a Saturday, Sunday, or holiday, you have until the next business day to file with no penalty.
Filing Extensions
Can’t file by the deadline? Virginia allows an automatic 6-month extension to file your return (Nov. 1 for most people). No application is required. You still need to pay any taxes owed on time to avoid additional penalties and interest. Make an extension payment.

- Make your checks or money orders payable to the Virginia Department of Taxation. To pay by credit card, go to the Virginia Department of Taxation website.
- If you live in another state but worked in Virginia and had Virginia taxes withheld from your paycheck in error, file Virginia Form 763-S — a special nonresident claim form — to get back the withholdings.
- If you live in another state and have rental property and/or business income from Virginia, file Virginia Form 763, a nonresident tax return.
- If you moved into or out of Virginia six months ago from another state, file Virginia Form 760PY, a Virginia part-year resident return.
- If you’re retired and don’t have Virginia withholdings taken out of your retirement income and want the income covered for Virginia taxes, file Virginia Form 760ES — a Virginia estimated tax form — or contact the Virginia Department of Taxation at 804-367-8031.
- Go to the Virginia Department of Taxation website to access most Virginia income tax forms.
Where’s my refund – Virginia?
Are you wondering where your Virginia state refund may be? Check the status of your Virginia state refund online at: https://www.individual.tax.virginia.gov/VTOL/tax/IndRefundStatus.xhtml.
You can also call 1-804-367-2486 for Virginia’s automated refund system.
To check the status of your refund:
- Enter your Social Security number
- Enter the tax year of the return filed
- Enter the expected refund amount (to the nearest dollar)
Both options are available 24 hours a day, seven days a week, and have the same information as customer service representatives, without the wait of the phone queue. You can check the status of your refund 72 hours after you file electronically or four weeks after you file a paper return.
E-filed tax returns take up to four weeks to receive your refund. Paper-filed returns can take up to eight weeks sent by certified mail allow an additional three weeks.
What can cause a delay in my Virginia state refund?
A number of things could cause a delay in receiving your Virginia refund, including the following:
- If the state needs to verify information reported on your return or request additional information
- If there are math errors in your return or other adjustments
- If you used more than one form type to complete your return
- If your return was missing information or incomplete

Some tax returns take longer to process than others for many reasons, including when a return:
- Includes errors such as an incorrect Recovery Rebate Credit amount
- Is incomplete
- Is affected by identity theft or fraud
- Includes a claim filed for an Earned Income Tax Credit or an Additional Child Tax Credit using 2019 income.
- Includes a Form 8379, Injured Spouse Allocation PDF, which could take up to 14 weeks to process
- Needs further review in general

How long will it take to get your refund?
General refund processing times during filing season:
- Electronically filed returns: Up to 4 weeks
- Paper filed returns: Up to 8 weeks
- Returns sent by certified mail: Allow an additional 3 weeks
The Where’s my Refund application shows where in the process your refund is. When we've finished processing your return, the application will show you the date your refund was sent. All returns are different, and processing times will vary.

What can slow down your refund?
- Your return was selected for additional review. As refund fraud resulting from identify theft has become more widespread, we’re taking extra steps to review all individual income tax returns we receive to be sure refunds go to the rightful owners. Additional safeguards can mean that it takes us longer to process your refund. However, our goal is to stop fraudulent refunds before they’re issued, not to slow down your refund. Learn more about our refund review process and what we're doing to protect taxpayers.
- Missing information or documents. If we send you a letter requesting more information, please respond quickly so we can continue processing your return.
- Errors on your return. We found a math error in your return or have to make another adjustment. If the adjustment causes a different refund amount than you were expecting, we will send you a letter to explain the adjustment.
- Problems with direct deposit. If you requested direct deposit, but the account number was entered incorrectly, your bank won't be able to process the deposit. When this happens, your bank notifies us, and we will manually re-issue your refund as a check. This process could take up to 2 weeks between the time we receive notification from the bank and when you receive the check.

Why is your refund different than you expected?
Errors or missing information
If your tax return had one or more errors, we may need to adjust your return leading to a different refund amount than you claimed on your return. We will send you a letter explaining the adjustments we made and how they affected your refund. If you have questions about the change, please call Customer Services.
Tax refund offsets - applying all or part of your refund toward eligible debts
- If you owe Virginia state taxes for any previous tax years, we will withhold all or part of your refund and apply it to your outstanding tax bills. We will send you a letter explaining the specific bills and how much of your refund was applied. If you have questions or think the refund was reduced in error, please contact us.
- If you owe money to Virginia local governments, courts, other state agencies, the IRS, or certain federal government agencies we will withhold all or part of your refund to help pay these debts. We will send you a letter with the name and contact information of the agency making the claim, and the amount of your refund applied to the debt. We do not have any information about these debts. If you think a claim was made in error or have any questions about the debt your refund was applied to, you'll need call the agency that made the claim.
If you have a remaining refund balance after your debts are paid, we will send a check to the address on your most recent tax return. We cannot issue reduced refunds by direct deposit.

Why did you receive a check when you requested direct deposit?
You will receive a check if:
- Your refund was reduced because we withheld part of your refund to pay authorized debts as explained above.
- We adjusted your refund amount. We will send you a letter explaining why the refund was adjusted.
- Your bank account information was incorrect or the bank account was closed.
- You provided a routing number for a bank located outside the territorial jurisdiction of the United States. Due to electronic banking rules, we cannot make direct deposits to or through international financial institutions.
